Website terms of use

Terms for using this website.

These terms govern use of the public Rajesh Hiralall Attorneys website. They do not replace a client mandate, engagement letter, fee agreement, court rule or other terms that may apply if the firm formally agrees to act for you.

1. About these terms

By using this website, you agree to these terms to the extent permitted by applicable law. If you do not agree, you should stop using the website. The firm may update these terms when the website, services or legal requirements change. The current version will be published here.

2. Website information is not legal advice

The website contains general legal information, service descriptions, guides, FAQs, calculators and estimated processes. It is not legal advice on your facts and should not be treated as a substitute for advice after considering the relevant documents, deadlines, forum and circumstances.

3. No attorney-client relationship merely from website use

Visiting the website, using a calculator, sending an enquiry, email or WhatsApp message, or receiving an automated acknowledgement does not by itself create an attorney-client relationship or confirm that the firm has accepted a mandate. The firm must first complete any necessary intake, conflict and professional checks and agree to act.

4. Enquiries, urgency and deadlines

An online enquiry is a request for contact, not a guarantee of immediate response. Do not assume that sending an enquiry suspends prescription, court dates, appeal periods, filing deadlines, statutory notices or any other time limit. If a matter is urgent, use the telephone or urgent contact route and obtain specific advice promptly.

5. Confidential and sensitive information

Do not send more confidential, privileged or sensitive information than is reasonably necessary in an initial website enquiry. Do not upload or send passwords, banking credentials, original documents or extensive sensitive records unless the firm has asked for them through an appropriate channel.

6. Acceptable use

You may use the website for lawful personal or business purposes connected with obtaining information about the firm or its services. You may not:

  • interfere with, probe, attack, overload or attempt to bypass the website’s security or access controls;
  • submit false, unlawful, abusive, malicious or automated enquiries;
  • attempt to access private dashboards, systems, records or data without authority;
  • use the website or its content to infringe another person’s rights; or
  • copy or exploit substantial website content in a way that infringes applicable intellectual-property rights.

7. Intellectual property

Unless otherwise indicated, the website’s original text, design, structure, branding and other original material are owned by or licensed to the firm and are protected by applicable intellectual-property law. You may view, print or save reasonable extracts for personal reference. No broader licence is granted merely because material is publicly accessible.

8. Calculators, estimates and quoted figures

Any cost calculator, transfer-duty figure, professional-fee guideline, timing estimate or similar output is indicative unless expressly confirmed in a written quotation or mandate. The actual amount or process may depend on taxes, tariffs, third-party charges, disbursements, transaction structure, instructions and later changes in law or published rates.

9. External links and third-party services

The website may link to courts, regulators, legislation, public authorities, maps, messaging platforms or other third-party services. Those services are controlled by their own operators. A link does not mean the firm controls or guarantees the third-party service, content, availability or privacy practices.

10. Website availability and security

The firm aims to maintain a useful and secure website but does not guarantee uninterrupted availability, error-free operation or that every feature will always be available. Maintenance, service-provider issues, internet failures or security events may affect availability.

11. Accuracy and reliance

The firm takes reasonable care with public website content but legal information can become outdated and may not cover every exception. Where a page records an update or verification date, that date should be considered when assessing the information. Obtain specific advice before acting on a material legal issue.

12. Liability

To the fullest extent permitted by applicable law, the firm is not responsible for loss arising solely from reliance on general website information instead of obtaining advice on the relevant facts, or from third-party services outside the firm’s control. Nothing in these terms excludes or limits liability, duties or rights that cannot lawfully be excluded or limited.

13. Privacy and cookies

Use of personal information through the website is addressed in the Privacy Notice. Browser storage and optional measurement are explained in the Cookie Policy. Visitors can reopen Cookie settings from the footer.

14. PAIA and access to records

Requests for access to records are governed by PAIA and the firm’s PAIA Manual. Nothing in these website terms creates a right of access beyond applicable law.

15. Governing law

These website terms are governed by the laws of the Republic of South Africa. Any dispute relating solely to use of this website is subject to the jurisdiction of a competent South African court, without limiting any statutory forum or remedy that must remain available under applicable law.

16. Severability and no waiver

If a provision of these terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure or delay in enforcing a provision does not by itself waive the right to enforce it later.

17. Contact
